1.- COMPANY ORGANIZING THE PROMOTION

The company SDA EUROPE SLU, hereinafter “Mellerware”, with registered office at Calle Balmes, 351, 1º1ª, 08006, Barcelona and identification number B-67524504, is organizing for promotional purposes the draw (hereinafter “the Promotion”) of national scope, to be developed through the Internet, exclusively for users resident in Spain and of legal age in accordance with the provisions of the section on conditions for participation.

2.- START DATE AND END DATE

The Promotion will run from 9:00 a.m. on December 1, 2023, to 11:59 p.m. on December 24, 2023.

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

The participation requirements will be the following:

- Those who reside in Spain and are over 18 years of age may participate.

- Only those participants who register in the form with their name and email will be able to participate.

- The personal data with which participants fill out the registration form must be true.

- Participants may participate in this promotion only once per day.

The mechanics of the Promotion consist of:

1.- Users must enter the website www.mellerware.com to participate and have the chance to win the daily prize.

2.- Within the advent calendar, there will be 24 boxes to open. Each day you must open the box corresponding to the day in question.

3.- Only those users who register in the form with their name and email will be able to participate.

4.- The prizes that have been given in previous days will be visible to all users for 24 days.

5.- The gift card will be compatible with discount codes. A user can apply a discount code to the shopping cart and then use the gift card.

6.- The gift card will only be valid and must be used with the email of the winning user.

7.- The gift card will be valid until December 31, 2024.

4.- PROMOTION CONDITIONS AND PRIZES

There will be one winner each day, from December 1st to December 24th, for a total of 24 prizes:

- 21 prizes will be: €10 gift card to spend on the website.

- 1 prize will be: €25 gift card to spend on the website.

- 1 prize will be: €50 gift card to spend on the website.

- 1 prize will be: €100 gift card to spend on the website.

Each daily prize can only be won by 1 participant.

Winners will be contacted by email on the following business day. They will be sent an email confirming they have won, along with the discount voucher.

5.- LIMITATIONS

If it is found that any of the participants does not meet the requirements set out in the Rules, or the data provided to participate is not valid, their participation will be considered void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the Participants, and may not be exchanged for any other product or for money.

Mellerware reserves the right, if there is just cause and after prior notification in legal form, to make any changes, suspend or extend this Promotion.

Any fiscal or tax burden that acceptance of the prize may entail, as well as any other expense derived from the promotion that is not expressly assumed by Mellerware in these Legal Bases, will be borne by the winner.

A period of FIFTEEN (15) calendar days from the date of the award of the prize is established to make any motivated claim. Mellerware reserves, in case of necessity, the right to replace the prize with another of similar characteristics.

6.- EXONERATION OF LIABILITY

By way of example, but not limited to, we are not responsible for any possible losses, thefts, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion, and we do not assume any responsibility for any damage or harm of any kind that the Participants, winner or third parties may suffer.

We do not assume responsibility in cases of force majeure or unforeseeable circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of Mellerware and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

7.- PROTECTION OF PERSONAL DATA

The company responsible for processing your data is SDA EUROPE SLU, with registered office at Calle Balmes, 351, 1º1ª, 08006, Barcelona and identification number B-67524504.

Mellerware takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care.

In accordance with the provisions of the applicable regulations on data protection, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Terms and Conditions, consents to the personal data provided for participation in this competition being incorporated into a file owned by Mellerware to process participation in the competition and to notify you of the prize if you are the winner.

We inform you that your personal contact information will be used for the following purposes:

Become part of the Mellerware database for commercial use (sending newsletters, communication of news and promotions and other commercial communications). Participants guarantee that the personal data provided are true and are responsible for communicating any changes to them to Mellerware. Mellerware reserves the right to exclude from this promotion any participant who has provided false data. It is recommended to exercise the utmost diligence in terms of Data Protection by using security tools, and Mellerware cannot be held responsible for any illegal theft, modification or loss of data.

Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability. Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he or she has his or her habitual residence, place of work or place of the alleged infringement, if he or she considers that the processing of his or her personal data is not appropriate to the regulations, as well as in the event that he or she is not satisfied with the exercise of his or her rights.

The Supervisory Authority to which the complaint has been submitted will inform the complainant about the course and outcome of the complaint.

8.- CHANGES

We reserve the right to modify or expand these promotional rules, provided that this does not harm or undermine the rights of the participants in the Promotion.

9.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the city of Barcelona will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these bases.
